Alibis unconfirmed, stories jumbled, red flags littered along the investigative trail. If you've ever watched a show involving criminal investigations, you've heard the cliché detective phrase "their alibi checks out" or to the contrary "he/she has no alibi". An alibi is only as solid as the facts that back it up, but what if no one confirms those details? If police took everyone at their word and never checked into what they're told, the clearance rate of criminal cases would be miniscule. Take things with a grain of salt and verify every detail. When a man has disappeared, leaving everything behind, those details matter. Red Flag #1 – Date & Time Are Just Numbers How do we know when Brian really disappeared? According to his girlfriend, AW, she and Brian got into an argument on July 28th, following a welfare check that resulted in AW’s toddler being placed in a relative’s care. AW claimed that Brian contacted FM, a mutual friend, who then picked Brian up and took him to Boone County to purchase drugs. AW claims that this was the last time she saw or spoke to Brian. However, other statements given to police suggest that Brian was last seen some time on July 29th. As I said in Part 2, the times given in statements were conflicting. Did they leave Brian and AW’s residence in the late morning or mid-afternoon? Did they arrive at Carolyn’s residence around 2:30pm, like she claimed? Did FM pick his son up between 4:00-5:00pm? None of these details were definitively proven to be true. Red Flag #2 – Multiple Stops, Nothing to Show According to the timeline given by FM, he and Brian made multiple stops throughout the day on July 29th. Unfortunately, there is no record of interviews with employees that worked at the convenience stores and no verifiable statements made by those that crossed paths with Brian and/or FM that day. If FM did, as he claimed, pick up his wife and travel to Beckley to shop for school clothes that evening, wouldn’t there be some type of proof? A receipt, an employee confirming their presence at the store, records of clothing vouchers being used at a certain day and time…anything. In the records I’ve received, there is no mention of these details being verified. Could FM have been shopping with his wife and sons? Sure. Is there any evidence of him being in Beckley that evening? Not that I know of. Red Flag #3 – Show Me the Money
Red Flag #4 – Why Did Brian Go to Lynco? FM claimed that he attempted to drop Brian off at his residence but, when they saw that the “two females” were still there with AW, Brian allegedly said that he didn’t want to go home because he worried that AW would have him arrested. He then says that Brian asked to be taken to Lynco because he “had a buddy there”. My first issue with this is that no one knows who the “buddy” could be. Despite suggestions and incorrect reports, no one seems to know who Brian would have gone to see in Lynco. My second issue is that TM (one of the two females at Brian and AW’s residence earlier that day) says that she was not at the residence between 2:30pm and 9:00pm. If we believe TM, then FM’s claim that both females were still at the residence when he took Brian home is a lie, plain and simple. Red Flag #5 – The CK Stories
There has been talk of CK confessing to not only Brian’s murder, but at least one other murder, while at a bonfire/party. When referring to Brian’s murder, CK allegedly said that it was just supposed to be a robbery. Remember, there were two other murders in that area around the same time and both remain unsolved. Some believe that CK may have had a hand in one of those homicides and that the motive was likely drug-related. There was a possible sighting of Brian in a convenience store, with the witness saying that Brian came in looking “really messed up” and “asking for help”. She said that Brian went into the restroom and, when he came back out, two men (with identifiable almost-matching tattoos on their biceps) entered the store and took Brian outside. Brian was then placed into a vehicle in the parking lot. What does the future hold? Even though WVSP have basically dismissed the possibility of CK’s involvement in Brian’s disappearance/death, they do believe that he died back in late July 2011. Unless something significant is brought to light, I don’t think WVSP will make an effort to search for Brian’s remains. “We don’t really have missing persons; we just have bodies that we haven’t found yet.” The great divide between Brian’s loved ones and law enforcement only grows with each month and year that passes. I plan to continue my search for the possible location of Brian’s remains, as well as sorting through the mountain of lies to uncover the small bits of truth. Brian deserves to be found and laid to rest alongside his father. The prosecution of those responsible may not be an option now, but there are some that will not let go until Brian is found.
